Costs of arbitration / Consequences of the withdrawal by Claimant of its claims

'As Plaintiff has withdrawn all its claims, it shall bear all the costs of this arbitration, i.e., the fees and expenses of the Arbitral Tribunal and the administrative costs . . .

Plaintiff shall also bear Defendant's legal costs. Even though Defendant argued during the course of this arbitration that it involved identical facts and issues as case No. . . ., the solution chosen in this latter case (i.e., that each party has to bear its own costs) cannot be adopted by the Arbitral Tribunal, since it is not called any longer to examine the merits of the case and to decide whether, as in case No. . . ., Defendant participated in entering into an immoral agreement. Plaintiff, for its part, has always denied that the two cases were identical, and, as mentioned above, has refused their consolidation. The Arbitral Tribunal, taken into account the state and all circumstances of the proceedings, shall arbitrate and assess the amount of Defendant's costs at the sum of US$ . . .'
